Sales conditions

Any bidder acknowledges having read these general conditions below and

expressly accepting them.

They must identify themselves to Drouot Estimations prior to the sale in order

to be able to bid by telephone during the very sale. Requests for telephone

bids must be put in writing and accompanied by a valid identity document

as well as bank account details. Drouot Estimations will try to contact the

bidder by telephone during the sale but declines all responsibility if an error or

omission occurred in the course of this free service.

It is the buyer’s responsibility to check prior to his purchase whether the

property is subject to customs formalities for export or import to the chosen

destination.

A refusal or a delay of an authorization necessary for the export or the

import could not justify a delay of payment of the total sale price including

commission, expenses, rights and applicable taxes, nor any cancellation or sale

resolution by the successful bidder.

If a certificate of free circulation has been issued or if an application is in

progress, this will be specified when the lot is presented for auction.

No tax-free invoice can be established without official proof of export

Purchasers will pay in addition to the hammer price, a buyer’s premium of:

- 22% (VAT inc.) (for the books).

- 25% (VAT inc.).

- 1,2 % (VAT inc.) DrouotLive.

In accordance with the law, DROUOT ESTIMATIONS is responsible for the

contents stated in the catalogue, subject to amendments announced by the

auctioneer during the sale when presenting the lot.

The dimensions are given on an indicative basis.

No complaint related to restorations, small accidents, and condition will be

accepted as the public exhibition allows a proper examination by the buyer.

Indications about the condition are available upon request to the auctioneer in

charge of the sale.

* Objects presented containing less than 20% Elephantidae spp (I/A) ivory or

rhinocerotidae spp (I/A) horn, (I/A) processed, pre-Convention, prior to 2 March

1947 and therefore in accordance with EC Rule 338/97 of 09/12/1996 art.2-

Wmc, the French Orders of 16 August 2016 amended and 4 May 2017, are for

sale freely.

For an exit from the European Union, a CITES re-export certificate will be

required, which is the responsibility of the future buyer. The issuance of such a

document is not automatic.

For a possible re-export, it will be up to the successful tenderer to obtain

information - prior to any purchase - from the customs authorities of the

country concerned, particularly in the case of the United States.

**On the other hand, objects presented containing more than 20%

Elephantidae spp (I/A) ivory or rhinocerotidae spp (I/A) horn, (I/A) processed,

pre-Convention, prior to 2 March 1947 and therefore in accordance with EC

Regulation 338/97 of 09/12/1996 art.2-Wmc, and prior to 1 July 1975 and

therefore in accordance with the French decrees of 16 August 2016 amended

and 4 May 2017, may be marketed after declaration and obtaining a D permit.

To this end, the person awarded for having bid by any means whatsoever for

a lot containing more than 20% elephant ivory (elephantidae spp.) or rhino

horn (rhinocerotidae spp.), and manufactured before 3 March 1947, authorises

Drouot Estimations to make the necessary purchase declaration on his

behalf to the competent administration in accordance with Article 2bis of the

amended decree of 16 August 2016.

The successful tenderer, required to make a declaration, undertakes to provide

Drouot Estimations without delay with all the information necessary for this

purpose and to do all the due diligence that would be required of him by

Drouot Estimations to do so.

The successful tenderer alone shall be required to carry out all other

due diligence resulting from the particular nature of such a lot under his

responsibility. In particular, it is up to him to take the steps required by his

possible resale or export.

*** Coral specimen complying with the Regulations CE 338-97 art. 2.w.mc of

December 9th 1996. Prior to June 1, 1947.

Prospective purchasers of or incorporating endangered and other protected

species of wildlife such as, ivory, and certain species of coral, are advised that

several countries require a permit (e.g., a CITES permit) from the relevant

regulatory agencies in the countries of exportation as well as importation.

Accordingly, clients should familiarize themselves with the relevant customs

laws and regulations prior to bidding on any property with wildlife material if

they intend to import the property into another country, specicially if it is the

United States of America.

• Pre-Convention Chelonioidea spp (I/A) sea turtle shell specimen, prior to July

1, 1947 and therefore in accordance with EC Regulation 338/97 of 09/12/1996

art.2-Wmc.

Absentee and phone bids

Auctioneers and experts execute, free of charge, absentee and phone bids, for

those who cannot attend the sale.

Anyone wishing to set up a phone bid will need to send a request by email,

attaching a copy of his ID and bank details, at the latest the day before the

sale.

Experience reveals that communications are not always possible due to

technical problem or lack of reception, therefore a phone bid request assumes

that THE BUYER AGREES TO BID TO THE LOW ESTIMATE PLUS ONE MORE

BID in case the connection is lost for any reason.

Drouot Estimations cannot be responsible for failing to execute a bid.

Payment

Any purchase will need to be paid during or right after the sale.

Should the buyer fail to pay the amount due by cash, cheque or credit card,

the lot may be re-offered for sale, under the French procedure known as

“procedure de folle enchère”, immediately or at the first opportunity with

payment of the difference by the first bidder, proceedings of the payment at

the expense of the bidder, cancellation of the sale without any fees.

Payment can be made in the following ways:

- By credit card in the saleroom: Visa or Mastercard

- By certified cheque or crossed cheque in euros, upon presentation of a

valid passport. In case of payment by non-certified cheque, the collection of

purchase may be postponed until the money has been received.

Collections will be postponed for any payment by cheque above € 1,000 until

the funds have been credited to our account.

Any buyer who wants to make a payment by bank transfer from a foreign

account must take in account additional fees from his bank remaining at his

own charge.

- In cash (decret of June 24, 2015) : up to € 1,000 (inc. premium) for French

citizens or professionals and up to € 15,000 (inc. premium) for foreign citizens

upon presentation of valid passport and evidence of residence abroad.

Collection and storage

Drouot Estimations will not send any sold item by mail and purchasers will

need to organize their own way of shipping.

If the buyer has no carrier, any request for shipping will have to be made

directly to The Packengers (hello@thepackengers.com) . Payment for the

transport must be made directly to The Packengers.

No purchase will be delivered without reception of full payment.

Bought lots remain entirely under the buyer’s responsibility as soon as the sale

has happened.

Any lot bought from Drouot Estimations and not collected

on the day of the sale, will be sent and stored at Drouot Warehouse with

daily storage fees applying (contact : 01 48 00 20 18 - magasinage@drouot.

com).

Benefit from Drouot Art storage facility.

At the end of the auction, lots can be collected for free in the room until 7pm

and the day after between 8am and 10am.

Beyond that time, goods that were not handled by the Auction House are

stored in DROUOT MAGASINAGE, at the following rates*:

Administrative fees / lot incl. VAT : € 5 / € 10 / € 15 / € 20 / € 25, depending on

the nature of the lot.

Storage and insurance fees / lot incl. VAT :

- Free, the first 4 working days.

- € 1 / € 5 / € 10 / € 20 / day, from the 5th working day, depending on the

nature of the lot.
